Terms & Conditions
Please read these terms carefully. By purchasing goods or services from ServiceBeaver, LLC, or by allowing us to work on your property, you accept and agree to be bound by these terms.
Updated April 20241 Acceptance and Terms and Conditions
Customer accepts these Terms by purchasing goods or services from ServiceBeaver, LLC or allowing them to work on their property. Written acceptance of proposals constitutes agreement. Terms may be modified by ServiceBeaver without notice.
2 Term for Maintenance Agreements
Maintenance Agreements run for one year from purchase date, first service date, or execution date—whichever is earliest. Auto-renewal occurs yearly unless terminated in writing 60 days before anniversary.
3 Invoices, Payments and Taxes
(a) Terms: Invoices due upon receipt unless otherwise agreed. Rental properties or remote responsible parties require advance payment.
(b) Customer is responsible for State or Federal Taxes. Tax exemption requires acceptable documentation.
(c) ServiceBeaver may adjust Maintenance Agreement pricing per cost-of-living and inflation indexes.
(d) Advance payment refunds subject to cancellation fees up to 100% covering labor, operational costs, materials, and profits. Scheduling fees refundable up to 3 business days before service. Cancellations within 3 business days are non-refundable.
4 Warranties
ServiceBeaver guarantees workmanship for 30 days to 3 years post-completion depending on project scope, conditions, materials, and customer-selected options. Standard warranty: one calendar year from completion or invoice date, whichever is earlier.
ServiceBeaver warrants labor quality but does not warrant products—manufacturer warranties transfer when applicable. Labor costs for defective parts removal/reinstallation are excluded from warranty coverage.
Warranty transfers upon property sale but duration remains unchanged.
Warranty becomes void when:
- Customer or third party modifies work
- Use or environmental conditions exceed design specifications
- External factors impact work (water damage, temperature extremes, acts of God)
- Customer fails to promptly report presumed warranty issues
Warranty excludes:
- Work beyond approved estimates and invoices
- Equipment, materials, products (customer or ServiceBeaver-supplied)
- Labor for failed equipment after delivery
- Incidental, consequential damages, loss of use
5 Price Estimates
(a) Firm estimates provided after inspection, but hidden damages discovered during work trigger price adjustments. Customers may discontinue projects and pay for completed work, materials, and expenses.
(b) Material price volatility may increase costs; ServiceBeaver bills price increases over original estimates.
(c) Minimum service charges: $175 Residential, $225 Commercial (varies by location).
(d) On-site inspections/diagnostics: $75 Residential, $90 Commercial (varies by location). Fee waived if estimate approved onsite and work begins same visit. Design and consulting fees non-refundable.
(e) Prices assume check or Zelle payment. Credit card payments incur 3.5% convenience fee.
(f) Permit costs excluded unless specified; processing fees billed separately.
6 Claims
Claims must be reported immediately upon identification. Completed service claims must be brought within 90 days of nonperformance discovery. Customer waives rights to unreported claims.
7 Cancellation and Termination of Maintenance Agreements/Plans and/or Service Calls
Maintenance Plan fees are prepaid yearly. Cancellation requires ServiceBeaver consent and payment of reasonable charges including incurred expenses, services rendered, and adjustments for concessions or discounts.
ServiceBeaver may cancel if payments are missed or customer cannot meet expectations. Written notice and 30-day cure opportunity required.
Customers may terminate for non-performance with written notice and 30-day cure opportunity. All incurred expenses and rendered services must be paid.
Project/service cancellations allowed up to 3 business days prior. Cancellations within 3 business days incur re-scheduling fees matching anticipated project duration (minimum $175 Residential, $225 Commercial).

10 Expectations from Customer
Customer agrees to:
- Allow safe access on agreed dates/times for personnel, equipment, materials during regular hours
- Promptly notify ServiceBeaver of unusual operating conditions
- Collaborate on scheduling with 24-hour advance notice of changes
- Provide access to utilities (water, power, internet) within reasonable distance
- Disclose pre-existing conditions and relevant work history
- Provide access to control panels, isolation valves in good working condition
- Provide safe, clear work areas with pets/animals removed
- Allow ServiceBeaver to isolate energy and services as needed
- Address mold, fungi, mildew, bacteria issues
- Identify/label asbestos-containing materials. For buildings/equipment older than 1981, provide written statement on asbestos absence/presence with determination method.
- Interact with ServiceBeaver associates respectfully and professionally
11 Exclusions
- Items outside agreed scope of work
- Hidden damages (additional cost)
- Work performed by others on ServiceBeaver work (voids warranty)
- Emergency/outside-hours work (Monday–Friday 8:30AM–5:00PM excludes holidays; additional cost unless agreed otherwise)
12 Confidential or Proprietary Information
Proposals are proprietary/confidential. Sharing with other companies/individuals/contractors prohibited without written approval. Exception: publicly available information. Customers cannot copy drawings, specifications, or data without written consent.
13 Hazardous Materials
ServiceBeaver is not responsible for identifying, detecting, abating, encapsulating, or removing asbestos, hazardous substances, or mold/fungi/mildew/bacteria. Work suspension permitted if hazardous materials encountered; performance timeline extends accordingly with compensation for delays.
14 Insurance
ServiceBeaver maintains Comprehensive General Liability insurance. Certificates of Insurance available upon request.
15 Intellectual Property and Proprietary Rights
(a) ServiceBeaver retains intellectual property ownership; licenses granted only for deliverable use.
(b) Devices installed or provided remain ServiceBeaver proprietary property—not fixtures. Customers acquire no interest/title/equity in hardware, software, processes, or proprietary rights.
(c) ServiceBeaver methods, processes, protocols are proprietary. Disclosed for Agreement performance only; customer must protect from third-party disclosure.

NOTICES: Written communications by personal delivery, confirmed fax/email, overnight courier, or certified mail (return receipt requested). All notices to ServiceBeaver: 520E Vine St. #1874, Keller, TX 76248, attention General Manager.
SEVERABILITY: Illegal or unenforceable provisions don't affect other Agreement terms.
